Judge Robert Leslie Hess Department 24. I was in court today watching a few hearings. A Korean pro se with his Korean interpreter were in court today. It seems disbarred attorney John Young Song sued Mr. Lee for slander, defamation, libel in LA Superior Court. Mr. Lee then sued John Song for suing him. Hearing was heard in front of Judge Robert Leslie Hess in Dept 24.

In agreeing that his conduct warranted disbarment, a three-judge review panel noted that the length of time over which Song’s conduct occurred places his misconduct “on the most serious end of the discipline spectrum for misappropriation.
“This is not a case of a single careless mistake. Song deliberately took substantial funds for his personal use with full knowledge that they belonged to his client,” the panel wrote. “In essence, he treated his CTA as an open-ended line of credit, justifying his withdrawals because he needed money for personal matters.”
In the client matter that led to his discipline, Song represented a family friend in a civil matter which resulted in an insurance company issuing a $145,528.77 check to the client. Although Song was required to maintain $133,699 in his client trust account as the client’s share of the proceeds, he began to draw from the account when he found himself unable to get in touch with the client. Song repaid the client after she filed a civil suit against him.
In mitigation, Song had no prior discipline record and has a long history of community service and pro bono work. He also cooperated with the State Bar investigation, presented witnesses and numerous declarations attesting to his good character.

The case was difficult because the Korean interpreter could have used an interpreter. He was almost as bad as the fake sign language interpreter at Nelson Mandela's funeral. He would sometimes just repeat in slow English what the Judge said to his Korean client. I understood what he said and meant but the Judge did not appear to understand and I don't blame him.
Disbarred attorney John Young Song sued Mr. Lee for defamation because he signed a statement for the DA in their investigation of John Song. Seems John Song embezzled money from his clients which is why he was disbarred, see below. Based on what I heard today Mr. Lee signed a statement stating he heard John Song on the phone threatening people saying "you will all die, I work for the government, do you know who I am?..." John Song also had to be removed by the Sheriff from court twice because of his behavior. He also supposedly threatened to harm people. Mr. Lee may have also been interviewed for Korean radio and television where he stated similar things when asked why he thought John Young was disbarred. He also said he believes John Young lost his mind when he was disbarred. This was all at a public hearing. Defendant John Song was not in the court room or on court call. Mr. Lee said he tried to serve John Song but he was never in his office. Judge Robert Leslie Hess then gave Mr. Lee legal advice telling him he just has to send it to the address on the court file. He doesn't have to personally serve him.
Judge Robert Leslie Hess then took a lot of time telling Mr. Lee to get a Korean attorney. He gave him many organizations, Korean bar associations, Korean embassies and other legal referrals to call. He gave him specific instructions on how to proceed, what he needs to file and when. His court aide gave Mr. Lee many names, phone numbers for help. Mr. Lee said his parents or mother is dying in Korea and he cannot afford an attorney.
I believe Judge Robert Leslie Hess spent so much time helping this Korean pro se because he was severely reprimanded for calling Asians "orientals." The Plaintiff stated it showed that Judge Hess is biased against Asians. Plaintiff stated calling an Asian an "oriental" is as bad as calling a black person a "nig***." I personally do not feel Judge Robert Leslie Hess was showing discrimination against Asians. Judge Robert Lee Hess was born May 21, 1948. In the 1960's and '70's people would call Asian people "oriental." I remember being seven and someone called an Asian "oriental." Someone else corrected them saying that is not the current politically correct term. Judge Robert Hess' wife Paula Hess who works at the LA County Museum of Art has friends and associates of all races. I don't think she is racist either. Most of her coworkers and friends are Asian. I think Judge Hess just chose the wrong word because he didn't know any better. What Judge Hess said about the case being frivolous was correct.
Judge Robert Leslie Hess had to recuse himself from the case because the backlash was so bad. It had to do with the silly lawsuit where Miley Cyrus and her friends slant their eyes with their fingers in a photo. Here is a website devoted to this situation made by another. The Plaintiffs lost the case. It was frivolous and meritless besides just plain silly. I still believe that Judge Robert Leslie Hess went overboard giving this Korean person legal advice, telling him what to file and when, telling him to contact the state bar, the DA, LAPD to report threats by John Song... I feel bad for the Korean guy because his reports to authorities are fair and privileged reports. They can never be defamation. His comments to the Korean news media were also merely his opinion. I can only hope John Song drops the case or gets arrested for embezzling funds from his clients.
One striking thing I noticed in court today was that 95% of the people wore ill fitting suits. They either lost or gained weight since they bought the suit and never had it refitted or it was never fitted in the first place. High water pants, jackets too tight or short, super baggy or tight shirts, womens skirts were too tight, they wore four inch stiletto heels, fish net stockings or skirts that were too short. I wore jeans and a sweater so who am I to talk.

JOHN YOUNG SONG [#176292], 47, of Los Angeles, was disbarred Sept. 27, 2013 and ordered to comply with rule 9.20 of the California Rules of Court.
A hearing judge found Song culpable of moral turpitude and failing to maintain client funds in trust as the result of his misappropriation of $112,293 from a client. Song made at least 65 unauthorized withdrawals from his client trust account over a three-year period.
