PETA wins Possum Drop lawsuit. Opossum injured during event.

PETA won the "possum drop" lawsuit in North Carolina. The department of wildlife resources should not have issued the permit.

"The Animal Rights group PETA has won the latest round in the legal wranglings over whether a Brasstown convenience store can use a live opossum in its New Year’s Eve “Possum Drop” festivities.

People for the Ethical Treatment of Animals issued a press release this afternoon stating that Wake County Superior Court Judge Allen Baddour ruled in their favor. The judge found the license the N.C. Wildlife Resources Commission issued last year to allow the use of a live, wild opossum was improperly issued.

“This means that the opossum used at this year’s event never should have been exposed to the terrifying crowds and noise of the cruel event,” the press release states. “Photos and video footage from this event show a frightened opossum unable to retreat from view and suffering from a visible eye injury, contusions to the nose, swelling of the face, and the first signs of dermal septic necrosis, a stress-induced illness that is fatal if not treated.”"

From the PETA press release:

This morning, Wake County Superior Court Judge Allen Baddour ruled in PETA’s favor by finding that the license allowing the exhibition of a live wild opossum at the New Year’s Eve Opossum Drop in Brasstown was improperly issued by the North Carolina Wildlife Resources Commission (WRC). This means that the opossum used at this year’s event never should have been exposed to the terrifying crowds and noise of the cruel event. Photos and video footage from this event show a frightened opossum unable to retreat from view and suffering from a visible eye injury, contusions to the nose, swelling of the face, and the first signs of dermal septic necrosis, a stress-induced illness that is fatal if not treated.

Today’s decision dissolved a previous ruling that allowed the New Year’s Eve opossum exhibition based on evidence submitted by the WRC—which the WRC has now admitted was “mistaken.” The “mistake” came to light during depositions of WRC’s representatives that showed statements made by the WRC at the previous court hearing were incorrect.

"In Brasstown, North Carolina an annual "hillbilly" event at Clay's Corner convenience store is organized by proprietors Clay and Judy Logan. At midnight on New Year's Eve, instead of dropping an inanimate object, a plexiglass pyramid containing a live possum was lowered from the roof of the store."
