The opinion on my appeal is due any day - Mary Cummins, Animal Advocates

When I initially filed my appeal they told me average time to release an opinion on a simple case is two to 2.5 months. My appeal was submitted September 9, 2013. It has now been over eight months. An almost identical case had an opinion in 7.5 months. That case was only for defamation. My case is defamation and breach of contract.

Based on the below guideline the initial draft of the opinion was submitted two months ago at six months. It appears that not all judges signed off on the first draft based on this time table.  Of course it does say "guidelines""recommend" which is not mandatory.

"Internal guidelines recommend that the author circulate an initial draft to panel members no later than 6 months after submission. The guidelines suggest that each panel member has 14 days to sign off on the draft, request a panel conference, or note that he or she intends to draft a concurrence or dissent. The panel member then has 60 days to circulate the draft of a concurrence or dissent. Additional time is allowed for subsequent opinion drafts."

I don't know if they include holidays or their vacation time in the six months. They generally release opinions on Thursdays. Their site says they don't release them electronically but they do. Should be out any day.
